Kaine: ‘They have all of the evidence at their disposal’
Several Democrats told The Hill that there is a “good chance” the Department of Justice will want to prosecute Trump, who has been blamed for “inciting” the riot at the Capitol.
Merrick Garland has not yet stated whether he intends to pursue Trump for prosecution.
The Senate Democrats did not provide any evidence to support Garland’s plans for prosecution. This raises questions about why The Hill asked Democrats.
The Hill still reported that Democratic Senators. Richard Blumenthal said that Tim Kaine, Tim Kaine, and Tim Kaine suggested that there could be evidence from the DOJ to prove Trump’s guilt without providing any details.
Kaine said, “They have all of the evidence at their disposal,” adding that there are “federal statutes that are very much implicated” by Trump’s efforts to stop the election certification prior to the riot.
“Garland is a sort of by-the-book guy,” Kaine said. “You have prosecutors who will talk about things, kind of give you status reports along the way. But that’s not really the most professional thing for prosecutors to do.”
Kaine continued, “What prosecutors usually do is they analyze all the evidence and then they either file an indictment or charge or they say nothing. If they file an indictment or charge, they let that speak for itself and they don’t editorialize about it.”
Democratic Sen. Sherrod Brown said of Trump and January 6, that he believes there’s “a lot of evidence that he was complicit” in sparking the riot.
“I think anybody who it’s proven had a role in the planning of (the January 6 attack) should be prosecuted, not just the people who broke in and smashed the window in my office and others,” Brown said.

Garland Vows To Prosecute Those ‘At Any Level’
Though Merrick Garland has not said he will go after Trump specifically, the attorney general said that he would prosecute those “at any level” for having a hand in what he called an “assault on our democracy.”
“The Justice Department remains committed to holding all Jan. 6 perpetrators, at any level, accountable under law — whether they were present that day or were otherwise criminally responsible,” Garland said.
House January 6 Committee subpoenaed at least 63 persons. They have also issued another round. This latest round included Nick Fuentes, a 20-year-old podcaster, and Patrick Casey.
