Ft. Lewis College Posting Policy Forbids “Hate Speech”

This was the “Speech Code of the month” by the Foundation for Individual Rights in Education. A public college may have some restrictions on student groups posting on campus. Bulletin boards and walls are considered “limited public forums” in which reasonable, neutral restrictions can be applied. Restrictions on the posting of “hate speech” or displaying it on nonpublic forums are viewpoint-based and therefore unconstitutional. Matal v. Tam 2017 Iancu v. Brunetti (2019)).
