GOP States Sue As Biden Adm. Lifts Title 42 Order, Expected To Create Surge Of Illegal Immigrants At Border

The three Republican Attorneys general are challenging the Biden administration for ending Title 42 border pandemic restraints.

Plaintiffs claim that the order was lifted illegally, and it will have an adverse impact on countries at the frontlines of the illegal migration crisis.

Republican States Back

The lawsuit was filed by Jeff Landry, Attorney General of Louisiana and Eric Schmitt, Missouri.

Title 42 has been a government health order since March 2020 that is used to rapidly turn away illegal immigrants. It is claimed that the purpose of Title 42 is to prevent legitimate refugees from entering this country.

According to the San Diego Tribune, some illegal immigrants tried crossing the border thirty times within a few weeks.

Further, “Nearly everyone interviewed by the San Diego Union-Tribune shortly after being expelled to Tijuana said that they had tried crossing the border three or more times in recent weeks in hopes of getting in.”

It is clear that the situation at the border does not work.

According to the lawsuit, part of the court case is:

“This suit challenges an imminent, man-made, self-inflicted calamity: the abrupt elimination of the only safety valve preventing this administration’s disastrous border policies from devolving into an unmitigated catastrophe.”

During an appearance on the Fox News Channel’s “Fox and Friends” Monday morning, Brnovich stated,

“We want to stop the Biden administration from rescinding Title 42 because it may be one of the most boneheaded decisions of this administration, and they have done a lot of dumb things. I’m doing everything I can to hold the Biden administration accountable and stop them from destroying our southern border.”

An Announcement Concerns Even Democrats

Title 42, the law that halts roughly 55% or more of the 164,000+ migrants crossing at the border every month in February, was enacted.

Some Democrats are concerned by the impact Title 42 will have on the border. After the announcement on Friday, Sen. Joe Manchin (D-WV) slammed the Biden administration, saying the move was a “frightening decision.” Manchin predicted that the influx of illegal immigrants will “only get worse.”

Earlier last week, Manchin had called on the Biden administration to make Title 42 permanent, and called the order “essential” for keeping numbers on the border from spiraling out of control even more.

Manchin declared,

“We are already facing an unprecedented increase in migrants this year, and that will only get worse if the Administration ends the Title 42 policy. That influx will be difficult to manage. Until we have comprehensive, bipartisan immigration reform that commits to securing our borders and providing a pathway to citizenship for qualified immigrants, Title 42 must stay in place.”

Arizona senators Mark Kelly (D), as well as Kyrsten sinema (D), expressed concerns over ending DHS Secretary Alejandro Mayorkas’ order. Senator Maggie Hassan (D–NH), has stated that she was concerned about a surge at the border.

She tweeted, “The administration appears not to be prepared for a rapid end to Title 42.”

Potential border disaster

Title 42 is set to expire on May 23, according to the Biden government. Border Patrol agents and federal officers are all nervous about the influx of illegal immigrants who will attempt to cross the border.

According to reports, federal officials were concerned about 170,000 illegal immigrants crossing the border with their unaccompanied children and up to 13,000 others trying. But estimates are differing.

Fox News’ Hillary Vaughn reports that DHS sources are preparing for up to 500,000 people in six weeks after the termination of Title 42.

Val Verde County Sheriff Joe Frank Martinez warned of the impending border surge saying, “Last year, we were calling it a crisis. It is a disaster this year. This is the calm before the storm.”
