Should Sarah Palin’s Masked Singer Appearance Be Admissible in Her Libel Trial Against the N.Y. Times

Proposed trial exhibits for the N.Y. Times include:

81   3/11/2020   Masked Singer Video – Reveal

Palin’s lawyers declare that the document is inadmissible and will “assert objections on January 17 2022” (among other documents). This is the N.Y. Daily News (Noah Goldberg):

The former Republican candidate for vice president has asked a judge to keep her shocking March 2020 reveal as a contestant on “The Masked Singer” from jurors who will render a verdict in her defamation trial against The New York Times.

The jury shouldn’t see video of Palin singing “Baby Got Back”, by Sir Mix A Lot, while she was wearing a pink-and-blue fuzzy bear costume. This would be unfair to Palin’s former governor of Alaska. Lawyers for Palin argued that it would create “unfair prejudice or confusion.”

After taking off her mask, Palin revealed that the bear was part of my childhood nickname and the mama bear phenomenon.

It will be fascinating to find out what they come up with. Times‘ theory of relevance here is; but the story just struck me as so outré that I had to note it. The Media Law Resource Center MediaLawDaily provided the tip.
